Terms of Use

These terms govern the use of all websites hosted by OCAS at ocas.ca and ontariocolleges.ca, all online services delivered to the public by OCAS (via browser and application) and all OCAS accounts (the “Tools”).

By using and continuing to use the Tools, you agree to be bound by these terms, which OCAS may change from time-to-time by posting an update to its website.

You should read the terms carefully, check for updates regularly and if you have any concerns or wish to ask to be relieved from any particular terms, e-mail ask-us@ontariocolleges.ca.

1. Limited license and use

1.1 OCAS grants you a limited, non-exclusive, non-transferrable license to use the Tools for non-commercial purposes that are connected to the receipt of OCAS services. This includes printing and downloading content obtained via the Tools strictly for the above-described purpose.

1.2 You may not, directly or indirectly, attempt to disrupt or actually disrupt or impair or interfere with, alter or modify the Tools or any of their content.

1.3 Accounts are for personal use only. If you access an account on behalf of another person you confirm that you are authorized to do so and shall be liable and will indemnify and hold harmless OCAS, its affiliates, employees and agents, in the event the person you are acting on behalf claims you did not have such authority or the information you submitted was inaccurate.

2. Copyright

2.1 The Tools have been developed by and are the property of OCAS. All content that may be obtained via the Tools is protected by copyright, trademark and/or other intellectual property laws of Canada and other countries. Subject to the limited license to use the Tools described above, no person may copy, redistribute, reproduce or republish in any form unless that person has obtained the prior written consent of OCAS. Any infringement of the rights of OCAS may result in appropriate legal action.

3. Trademarks

3.1 OCAS owns product names, trade names, trademarks, service names, service marks, and logos (the “Marks”) in Canada, the United States, and in other countries. You may not use, reproduce, advertise, display, publish, or transmit any of the Marks without OCAS’s prior written consent. All other trademarks and logos displayed in the Tools are the property of their respective owners. The display of trademarks on this website shall not in any way be construed as an implied license to use such trademarks.

4. Disclaimer

4.1 The Tools are for informational purposes only and are not intended to provide you with any form of advice or recommendation upon which a specific decision should be made. You will not rely on the Tools as a substitute for independent research or for personal advice from a qualified advisor.

4.2 OCAS has done its best to ensure the accuracy and currency of the content that may be obtained via the Tools, but does not guarantee, represent or warrant that the information contained on this website is accurate, complete, reliable, verified, error-free or fit for any purpose.

4.3 The Tools present information about college and other third-party educational programs and offerings. This information does not constitute official information about programs and offerings (which may only be obtained directly from the third-parties) and does not form part of any contract between you and the third-parties you apply to or attend. Likewise, OCAS has no responsibility for and is not liable for any third-party application, admission or enrollment decisions.

4.4 OCAS expressly disclaims all representations, warranties or conditions, express or implied, statutory or otherwise, including, without limitation, the warranties and conditions of merchantable quality and fitness for a particular purpose, non- infringement, compatibility, timeliness, data security or accuracy, and any representations, warranties or conditions that may arise from a course of dealing or usage of trade.

4.5 You assume full responsibility for risk of loss of any nature whatsoever resulting from your use of this website. Without limiting the generality of the foregoing, you acknowledge and agree that none of OCAS, its affiliates (including each college of applied arts and technology) or any of their respective directors, officers, employees or agents shall be liable to you for loss of data, computer time or any loss or damage of any nature whatsoever arising out of or attributable in any manner whatsoever to your use or inability to use this website for any reason whatsoever or to any action or inaction on the part of OCAS or for any direct, indirect, special or consequential damages, even if OCAS has been advised of the possibility thereof, including but not limited to lost profits, lost opportunities or business revenues, loss of goodwill, or failure to realize expected savings.

4.6 The Tools include links to external websites. These links are provided to help you find additional information quickly and easily. OCAS accepts no responsibility for the content of these websites and specifically excludes (to the fullest extent permitted by law) all liability that may arise with respect to or as a result of such material causing damage, costs, injury or financial loss of any kind. We are not responsible for the content and the privacy practices of other websites and encourage you to examine each site’s privacy policy and disclaimers and make your own decisions regarding the accuracy, reliability, and correctness of material and information found.

4.7 Though the Tools may from time to time contain advertising material, OCAS does not endorse or accept any liability for any of the products or services so advertised, or for any error or inaccuracy in the advertisements. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Tools comply with all relevant laws.

5. General

5.1 These terms constitute the entire agreement between you and OCAS and supersede and replace any prior representations made by OCAS, written or oral, to the extent are related in any way to the subject matter hereof.

5.1 All rights not expressly granted herein are reserved to OCAS.

5.2 OCAS may, at any time, to suspend or terminate your access to, or use of, the Tools.

5.3 These terms shall be governed by and construed in accordance with the laws of Ontario and the laws of Canada applicable therein.

5.4 The Ontario courts shall have exclusive jurisdiction in relation to any claim, dispute or other matter arising in relation to these terms except, for the exclusive benefit of OCAS, OCAS shall have the right to bring proceedings in the courts of the country of residence of any user of the Tools.

5.5 If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these terms and conditions which shall continue to have full force and effect.

5.6 The failure by OCAS to exercise any right or remedy under these terms and conditions shall not constitute a waiver of that right or remedy.
